WHAT IS THE INTERNAL WHISTLEBLOWING SYSTEM – CONFIDENTIAL REPORTING SYSTEM?

Reporting (whistleblowing) is an extremely important tool for preventing and curbing corrupt practices, exposing financial and tax fraud, and other violations that threaten public safety and health, financial integrity and the rule of law.

It is the people who work for or are in a working contact with a private or public organization who are often the first to learn about threats or damages, leading in many cases to irreversible consequences, both for the organization itself and for the public interest as a whole.

The confidential reporting system Confidential Reporting System is a specially developed internal channel for reporting committed or imminent breaches of the Bulgarian legislation and the Acts of the European Union, within the organization, which is designed on the basis of the requirements of Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons who report breaches of Union law transposed in our national law through the Law on the Protection of Persons who Report or Publicly Disclose Information on Breaches. 

In the development of the SYSTEM, its creators TRANSPARENCY INTERNATIONAL – BULGARIA and "HAPPY COMPANY" LTD aim at ensuring that its management process guarantees comprehensiveness, integrity and confidentiality of the information flowing through it. An organization has been established to allow the introduction of such technical means for the processing of incoming data to ensure the protection of the identity of individuals by anonymizing personal data, including through cryptographic methods and means, as well as to prevent access of unauthorized persons to the information received. This is a prerequisite for some of the main advantages of the internal CONFIDENTIAL REPORTING SYSTEM, namely:

      • SECURITY, (guaranteeing)

      • CONFIDENTIALITY (signifying)

      • PROTECTION

    Through the introduction of the Confidential Reporting System the organization provides its employees and partners not only with security in a working aspect, but also with the protection of their identity.

     

    WHICH BUSINESSES AND ORGANIZATIONS SHOULD MAINTAIN A CONFIDENTIAL REPORTING SYSTEM?

    • Public sector employers, including municipalities.
    • Private sector employers with 50 or more employees.
    • Employers in the private sector regardless of the number of employees, if their activities fall within the scope of EU acts.
